1. About Us
Seafari Adventures Curaçao ("Seafari", "we", "us") operates premium boat tours and private charters departing from Willemstad, Curaçao. By booking a tour or service through our website or any partner platform, you agree to these Terms & Conditions in full.
2. Bookings & Payment
- All bookings require full payment at the time of reservation. Availability is only guaranteed upon receipt of full payment.
- Prices are listed in US Dollars (USD) and are inclusive of all stated inclusions (equipment, drinks, guide). Prices exclude optional gratuities.
- Booking confirmation is sent by email. It is the guest's responsibility to provide a correct email address.
- We reserve the right to correct pricing errors at any time before departure. In the event of a pricing error, guests will be notified and offered a full refund or the corrected price.
- Promotional codes and discounts cannot be combined unless explicitly stated. One code per booking.
3. Cancellation & Refund Policy
We understand that travel plans change. Our policy is designed to be fair to both guests and our operations:

To cancel, contact us via email at hello@seafariadventurescuracao.com or WhatsApp. Cancellations are effective upon written confirmation from Seafari Adventures.
Refunds are processed within 5–10 business days to the original payment method.
4. Weather & Safety Cancellations
The safety of our guests and crew is our absolute priority. The captain has sole authority to cancel or modify a tour due to adverse weather conditions, unsafe sea state, or any other safety concern, at any point before or during the tour.
If Seafari Adventures cancels a tour for safety or weather reasons:
- Guests receive a full 100% refund, or
- Free rebooking to another available date, at the guest's choice.
We do not compensate for travel costs, accommodation, or other consequential expenses resulting from weather cancellations.
5. Rescheduling
Guests may reschedule their booking free of charge up to 48 hours before departure, subject to availability. Rescheduling requests within 24 hours of departure are treated as cancellations under Section 3.
6. Health, Fitness & Participation Requirements
- Guests must be able to board and disembark the vessel safely. Boarding requires physical agility as the vessel may move in swell.
- Guests with heart conditions, back or neck injuries, pregnancy, epilepsy, or other medical conditions that may be aggravated by boat travel or water activities should consult a physician before booking and must inform us at the time of booking.
- Children under 4 years of age are not permitted on board. Children aged 4–12 must be accompanied by a parent or legal guardian at all times.
- Guests who are visibly intoxicated or under the influence of drugs at the time of departure will be refused boarding without refund.
- Swimming ability is recommended for snorkeling stops. Life jackets are provided and mandatory for non-swimmers during water activities.
- Minimum age for snorkeling participation: 4 years old.
7. Liability & Risk
Participation in boat tours, snorkeling, and water activities involves inherent risks including but not limited to: adverse sea conditions, marine wildlife encounters, slip and fall hazards, and sun exposure. By booking with Seafari Adventures, guests acknowledge and accept these risks.
Seafari Adventures carries liability insurance in accordance with Curaçao maritime regulations. Our liability is limited to direct damages caused by proven negligence on our part and shall not exceed the amount paid for the tour.
We are not liable for:
- Personal injury resulting from failure to follow crew instructions
- Loss or damage to personal belongings, cameras, or valuables
- Seasickness or discomfort from sea conditions
- Missed connections, flights, or cruise ship departures
- Adverse reactions to sun exposure, reef-safe sunscreen, or provided food and drinks (guests with allergies must inform us in advance)
8. Personal Belongings & Valuables
We strongly advise guests not to bring valuables, passports, or large amounts of cash on board. Seafari Adventures accepts no liability for lost, stolen, or damaged personal property. Waterproof bags or pouches are recommended for cameras and phones.
9. Behaviour On Board
Guests are expected to behave respectfully towards fellow guests, crew, and the marine environment. The captain and crew have full authority over the vessel and may request a guest to leave the vessel at the nearest safe point, without refund, if their behaviour:
- Endangers the safety of others or the vessel
- Is abusive, aggressive, or discriminatory
- Causes damage to the vessel or equipment
- Disrupts other guests' enjoyment
Guests are financially responsible for any damage they cause to the vessel, equipment, or marine environment (e.g. touching or breaking coral).
10. Environmental Responsibility
We operate in a protected marine area. Guests must:
- Use only reef-safe sunscreen (we provide it on board)
- Not touch, stand on, or remove coral or marine life
- Not feed fish or marine animals
- Not litter overboard
Guests who violate environmental rules may be removed from the tour without refund and may be reported to Curaçao maritime authorities.
11. Photography & Video
Seafari Adventures may photograph or film guests during tours for use in marketing materials, social media, and website content. By participating in a tour, guests grant Seafari Adventures the right to use such images. Guests who do not wish to be photographed must inform the crew at the start of the tour.
Guests may not sell or commercially license photographs or video taken during Seafari Adventures tours without written permission.
12. Force Majeure
Seafari Adventures is not liable for failure to perform or delays caused by circumstances beyond our reasonable control, including but not limited to: acts of God, hurricanes, government orders, strikes, pandemics, fuel shortages, or mechanical failure. In such cases, we will offer a full refund or free rebooking where possible.
13. Intellectual Property
All content on seafariadventurescuracao.com, including text, photography, video, and branding, is the property of Seafari Adventures Curaçao. Reproduction or commercial use without written consent is prohibited.
14. Privacy
Personal data collected during booking is used solely to manage your reservation and send service-related communications. We do not sell personal data to third parties. For questions about your data, contact hello@seafariadventurescuracao.com.
15. Governing Law & Disputes
These terms are governed by the laws of Curaçao. Any disputes arising from these terms or a booking shall first be submitted to mediation. If mediation fails, disputes shall be resolved by the competent court in Willemstad, Curaçao.
We are always willing to resolve issues amicably. Before initiating any formal dispute, please contact us directly at hello@seafariadventurescuracao.com.
16. Changes to These Terms
Seafari Adventures reserves the right to update these terms at any time. The version in effect at the time of your booking applies to your reservation. Continued use of our website after changes constitutes acceptance of the updated terms.
